Katie Iams represents business and professional clients in all phases of federal and state court litigation, from pre-suit dispute resolution through appeal, with a particular focus on real estate litigation. 

Her experience includes managing large eminent domain projects for utility companies, litigating land use and easement issues for private utility companies, advising developers in land use disputes, and advising clients regarding lease and development disputes, appraisal issues, and other areas of commercial real estate litigation. She has extensive knowledge of all aspects of eminent domain proceedings throughout North Carolina, including in jury trials, mediations, acquisitions, and commissioners’ hearings for both condemning authorities and commercial property owners and tenants. Her experience on both sides of the condemnation aisle allows her to reach resolutions that make business sense for her clients.

In addition, Katie works with clients in disputes involving contractual claims arising from a variety of business relationships, including fraud, misrepresentation, breach of fiduciary duty, and unfair and deceptive trade practices. She also represents financial institutions on a wide variety of issues, including actions involving allegations of lender liability.

Katie is admitted to practice before the United States District Courts for the Western, Middle, and Eastern Districts of North Carolina and the Fourth Circuit Court of Appeals.

Representative Experience

Real Estate Litigation

  • Managed acquisitions of multiple easements and rights-of-way for private condemnors in connection with multi-mile right-of-way projects across numerous counties within North Carolina.
  • Advised utility about right-of-way acquisition in a high-profile, multibillion-dollar project.
  • Successfully negotiated multiple complex easement and right-of-way agreements on behalf of both condemning authorities and commercial property owners and tenants.
  • Regularly enforced and upheld easement rights by securing temporary and permanent injunctive relief in state court proceedings.

Commercial Litigation

  • Litigated breach of contract claims arising from asset purchase agreements, franchise and distributor agreements, real property leases, and all forms of commercial contracts.
  • Won defense verdict at trial in litigation filed by franchisee alleging breach of contract, fraud, and various other claims against the franchisor.
  • Reached favorable settlement in breach of contract action involving allegations of fraudulent transfer, unfair and deceptive trade practices, and successor liability claims.

Financial Services Litigation

  • Defended financial institutions from lender liability claims, including borrower/guarantor claims for misrepresentation, fraud, tortious interference with business, negligence, unfair trade practices, and related tort actions.
  • Managed the workout of large loan portfolios for lenders involving hundreds of real property foreclosures/note collection lawsuits.
  • Successfully resolved banking litigation cases involving loan and deposit products.
