Carson Lane is a litigator who primarily defends employers in state and federal employment claims. She has experience handling issues arising under Title VII, the Family and Medical Leave Act (FMLA), the Americans with Disabilities Act (ADA), the Age Discrimination in Employment Act (ADEA), and the Fair Labor Standards Act (FLSA). She also counsels clients on wage and hour laws, wrongful discharge in violation of public policy, theft of trade secrets, breach of contract, and other issues arising out of the employment relationship.

In addition, she has represented employers in dozens of administrative charges before the Employment Opportunity Commission (EEOC) and North Carolina North Carolina Department of Labor Retaliatory Employment Discrimination Bureau (REDA) against allegations of discrimination, harassment, and retaliation based on age, race, gender, disability, religion, and national origin. Carson strives to not only find the best legal solutions to complex employment issues her clients face, but also to understand their industries and businesses. She has specific experience representing employers in the technology, manufacturing, and distribution industries.

In addition to defending employers in litigation and administrative actions, Carson also helps employers best position themselves to avoid legal actions in the first place by advising human resources professionals and other corporate executives on employee personnel actions, including hiring, discipline, and termination, conducting effective internal investigations into misconduct and criminal acts in the workplace, and drafting clear and compliant policies and procedures, including employee handbooks. Finally, Carson routinely drafts and negotiates employment, separation, and consulting agreements, particularly with respect to noncompetes and other restrictive covenants, and compensation plans.

Carson is also a member of the firm’s Education Industry Team, and has experience representing higher education clients in litigation, investigations, and in drafting legally compliant policies and internal procedures.

Prior to joining Parker Poe, Carson practiced labor and employment law at an international law firm.

Representative Experience

  • Defended employers in dozens of administrative charges before the Employment Opportunity Commission (EEOC) and North Carolina North Carolina Department of Labor Retaliatory Employment Discrimination Bureau (REDA) involving claims of discrimination, harassment, and retaliation based on age, race, gender, disability, religion, and national origin.
  • Represented employers in litigation in North Carolina state and federal courts in claims arising under Title VII, FMLA, ADA, ADEA, FLSA, state wage and hour laws, wrongful discharge in violation of public policy, breach of contract, and other state law claims arising out of the employment relationship.
  • Drafted employment agreements, restrictive covenants, employee handbooks and employment policies, and reductions in force, and employee separation agreements.
  • Counseled and advised human resources professionals and other corporate executives and managers with respect to individual employee personnel actions, including hiring, discipline, and termination.
  • Obtained dismissal of claims of retaliation and race discrimination in a North Carolina federal court matter.
  • Drafted appellee’s brief to the North Carolina Court of Appeals in North Carolina Wage & Hour Act claim (order granting motion to dismiss affirmed).
  • Defended an international technology company in claims of gender harassment and discrimination.
  • Represented higher education clients in litigation, investigations, and in drafting legally compliant policies and internal procedures.
  • Managed global reduction in force for manufacturing client conducting layoffs across nine countries.
