Hailey Klabo advises creditors and other parties in connection with bankruptcy cases, out-of-court restructurings, and workouts.

She previously worked in the restructuring practice for one of the 30 largest global law firms. She has also served as a judicial clerk to the Honorable William Osteen Jr. of the U.S. District Court for the Middle District of North Carolina and as a judicial extern to the Honorable Benjamin Kahn of the U.S. Bankruptcy Court for the Middle District of North Carolina.

Hailey earned her law degree from the University of North Carolina, where she served as articles editor for the North Carolina Law Review. She also served as president of the Carolina Public Interest Law Organization. Hailey earned her undergraduate degree from Davidson College.

Representative Experience

  • Represented creditors and creditor groups in connection with out-of-court restructurings, refinancings, and recapitalizations. 
  • Represented a pharmaceutical company in its Chapter 11 restructuring filed in the Southern District of New York that sought to effectuate a comprehensive settlement of more than $40 trillion of asserted claims.
  • Represented a Brazilian cosmetics company in connection with the Chapter 11 filing of certain of its non-operations subsidiaries filed in the District of Delaware. Client provided a $43 million debtor-in-possession financing facility to the debtors and provided a $125 million stalking horse credit bid to acquire substantially all of the debtors' assets.
  • Represented an ad hoc group of creditors in connection with the Chapter 11 restructuring of an industrial wood pellet producer filed in the Eastern District of Virginia. The ad hoc group provided and backstopped a $500 million debtor-in-possession financing facility to the debtors and executed a restructuring support agreement that provided for the comprehensive restructuring of the debtors' capital structure, which included reducing the debtors' debt by approximately $1 billion. 
  • Represented an ad hoc group of lenders and noteholders in negotiating the restructuring of an air medical service, which resulted in a prepackaged Chapter 11 filing in the Southern District of Texas that reduced the company’s leverage by approximately $1.7 billion.
  • Represented a produce distributor in connection with the Chapter 11 bankruptcy of an indoor greenhouse facility filed in the Southern District of Texas. Client acquired certain assets and liabilities associated with one of the debtor’s facilities and entered into two long-term leases of two other greenhouse facilities in connection with the bankruptcy. 
  • Provided restructuring advice to the dealer managers for a multinational pharmaceutical and biotechnology company in connection with the split-off of one of the world’s largest pure-play consumer health companies. 
  • Represented an ad hoc group of first-lien noteholders in connection with the Chapter 11 bankruptcy of a major supply chain management services company filed in the Southern District of Texas. The ad hoc group provided a $300 million debtor-in-possession financing facility. 
  • Represented the lead arranger, administrative agent, and collateral trustee under a $1.76 billion superpriority debtor-in-possession credit facility, and the collateral trustee and administrative agent under a prepetition revolving credit facility to a power company in its Chapter 11 case filed in the Southern District of New York. 
  • Represented an ad hoc group of term loan lenders as plan sponsors in connection with the Chapter 11 bankruptcy of a legacy cosmetics company filed in the Southern District of New York.
