Global and U.S. leaders in their sectors turn to John Moye to pursue and defend against complex, multimillion-dollar disputes. John has approximately 20 years of experience representing companies in both federal and state courts and in arbitrations. He has provided litigation counseling and guidance to a range of companies across the software, manufacturing, telecommunications, technology, and life sciences industries. He has served as lead counsel in lawsuits involving technology and software, the theft of trade secrets, noncompetes and other restrictive covenants, intellectual property, and complex commercial disputes.

John is a leader in Atlanta's litigation community, serving on the board of directors for the Atlanta Bar Association's Litigation Section. He is adept at assisting his clients through a case's pleading stage all the way through trial, supervising electronic discovery, taking depositions, engaging in motions practice, and trying cases before judges and juries. He also has experience arguing cases at the appellate level, including before the North Carolina Supreme Court.

John also provides guidance as outside general counsel to clients in a variety of sectors, assisting them in achieving their business goals.

John frequently presents at conferences and continuing legal education events, including the International Technology Law Association (ITechLaw) annual conference. He also taught civil litigation for several years at the University of North Carolina School of Law.

John has built a robust pro bono practice, including representation of tenants in dispossession actions through the Atlanta Volunteer Lawyers Foundation and representation of detained immigrants in federal asylum proceedings. In 2017, he earned the Pro Bono Volunteer of the Year Award from the Georgia Asylum and Immigration Network (GAIN).

Prior to joining Parker Poe, John was a litigation partner at one of the 100 largest global law firms. He clerked on the United States Court of Appeals for the Eleventh Circuit for the Hon. Stanley F. Birch Jr. 

He earned his law degree from the University of North Carolina at Chapel Hill and his undergraduate degree from Georgetown University.

Representative Experience

  • Served as lead defense counsel for a publicly traded, Irish-based clinical research organization in a $15+ million complex software implementation and software licensing dispute. Won summary judgment before the North Carolina Business Court on seven of eight claims; Supreme Court affirmed and adopted significant precedent for negligent misrepresentation claims; secured second summary judgment that further narrowed the remaining issues; settled the case on favorable terms for our client. 
  • Serves as lead counsel for a national manufacturer and distributor of industrial cleaning supplies, specialty chemicals, lubricants, and water treatment products, and has handled a range of litigation matters including restrictive covenant cases and complex contract disputes.
  • Defended a leading global software company in multimillion-dollar arbitration and litigation concerning allegedly unpaid sales commissions; resolved the cases on the eve of the arbitration proceedings with very favorable outcomes for our client.   
  • Served as lead trial counsel in a five-day jury trial and prevailed on all pending claims on behalf of an Ohio-based manufacturer of alloy castings in federal case involving alleged breaches of a profit-sharing agreement, disputes over intellectual property ownership.
  • Provides corporate counsel and guidance to large, Irish-based manufacturer and distributor of dairy products with a global distribution network. 
  • Serves as lead counsel for a publicly traded software company in various employment-related contract and commission disputes. 
  • Serves as lead counsel to a publicly traded distributor of hydroponic equipment, lighting products, and other cultivation products in a multimillion-dollar complex software implementation dispute in the U.S. District Court for the Northern District of Georgia.
  • Served as counsel to Atlanta-based art dealer in contractual dispute arising out of distribution of commissions from art transactions.
  • Obtained summary judgment and a dismissal of all claims in the representation of a large telecommunications provider in dispute brought by a hardware vendor alleging claims for business defamation, unfair trade practices, and other torts.
  • Represented large global adhesive manufacturer in the U.S. District Court for the Eastern District of North Carolina in a case involving a former employee's misappropriation of trade secrets and intellectual property.
  • Obtained a jury verdict granting ownership of all related patents for a software company that conducts research and invents patentable technologies in the field of wireless technologies, following a three-week jury trial in the North Carolina Business Court, regarding a dispute with a former employee-inventor over the ownership of certain patents.
  • Represented large telecommunications provider in federal lawsuit brought by a number of rural telecommunications companies located in the Carolinas, arising out of the provision of "Long Term Evolution" wireless technology.
  • Represented Atlanta-based company that provides SEC consulting services in lawsuit against former employees and officers, involving concurrent litigations regarding theft of trade secrets, breach of restrictive covenants, and unfair competition in the Northern District of Georgia, the District of New Jersey, and an arbitration before the AAA in New York.
  • Served on the compliance monitor and auditor team of a German vehicle manufacturer, assisting German and U.S. entities on their document retention, legal hold, and e-discovery policies and procedures.
  • Served on a government-appointed monitorship team supervising the U.S. export control compliance of one of the largest telecommunications companies in China.
